CURIOSITIES & ODDITIES AT NEW YORK COMIC-CON 2025
 

EVENT ACCESS AND ADDITIONAL PURCHASE TERMS AND CONDITIONS

 

Important: To participate in this Event, you must agree and abide by these Terms and Conditions and all decisions of Funko, LLC (“Sponsor”), which are final and binding in all respects.

NO PURCHASE OR PAYMENT NECESSARY.

Promotion void where prohibited by law. Subject to applicable federal, state, and local laws.

 

If a purchase transaction is not completed by the end of the Event due to attempted payment for selected item(s) being rejected or for any other reason (including, by way of example only, being late, lost, corrupted, jumbled, garbled, delayed, destroyed, misdirected, inaccessible or otherwise irregular/defective), the opportunity to access the Event will be rescinded by Sponsor without liability of any kind.

 

  1. Event Access: Access to the event will be on a first-come, first-serve basis as managed by an automated waiting room. Depending on the volume Event traffic, Event Participants who visit www.funko.com/mx or www.loungefly.com/mx following the applicable Start Time may be placed into a waiting queue upon checkout on a first-come basis. The Event will start (the “Start Time”): (a) for consumers in United States, Canada and Mexico at 9:00 a.m., Eastern Time, on October 9, 2025 and (b) for consumers in the UK, EU and UAE at 4:00 p.m., British Standard Time, on 9 October 2025.
  2. Event Purchase Terms: Participants in the Event may elect not to purchase any products during the Event without liability or obligation of any kind.  Any purchases of Sponsor’s NYCC 2025 products (each an “Event Exclusive”) during the Event are subject to the following terms and conditions in addition to the terms and conditions set forth at https://funko.com/mx/terms-and-conditions/terms-conditions.html:
    1. Product Availability.
      1. Multiple checkouts by a single Event participant are not allowed. If a participant attempts or completes more than one checkout transactions, any and all transactions are subject to cancellations as set forth below.
      2. Limit one (1) unit per NYCC 2025 Bundle (SKU: 95469) per household.  Orders for multiple NYCC 2025 Bundles (SKU: 95469) are subject to cancellation as set forth below. 
      3. Limit two (2) units of all Limited Edition Event Exclusives (SKUs: 88112, 88113, 88114, 88123, 88124 and 88126) per household.  Orders in excess of this limit are subject to cancellation as set forth below. 
      4. Limit six (6) units of all other Event Exclusives per household.  Orders in excess of this limit are subject to cancellation as set forth below. 
      5. Not all Event Exclusives are available in all jurisdictions.
      6. Access to the Event does not guarantee the availability of any Event Exclusive.  Quantities of Event Exclusives are very limited, and all Event Exclusives are expected to sell out. 
    2. Purchase Details, Verification and Cancellation.  All purchases of Event Exclusives are subject to verification prior to processing and shipping.  Purchases may be cancelled at any time prior to shipment in the following circumstances:
      1. Sponsor determines that the purchase was the result of unauthorized access to the Event.
      2. The same purchaser attempts to complete more than one transaction.
      3. Sponsor determines excess quantities of the same Event Exclusive were purchased by purchasers in the same household in one or more transactions.
      4. Sponsor determines that the purchaser interfered with or undermined, or attempted to interfere with or undermine, the legitimate operation of the Promotion or the Event.
      5. Sponsor determines that a purchase was made by automated means (including purchases made using any script, macro, bot or promotional service).
      6. The purchase transaction was not completed by the scheduled end of the Event.
    3. No Returns.  Event Exclusives are considered “Exclusives” for the purposes of the Company’s returns policy, available at https://funko.com/mx/funko-returns-policy/funko-returns-policy.html.
  3. Disclaimer: Sponsor and its parent companies, subsidiaries, affiliates, directors, officers, professional advisors, consultants, contractors, legal counsel, public relations firms, employees and advertising, fulfillment and marketing agencies (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions; (b) phone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures beyond Sponsor’s or the Released Parties’ reasonable control; (c) any Event disruptions, injuries, losses or damages caused by events beyond the reasonable control of Sponsor or the Released Parties by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Event.
  4. Limitations of Liability; Releases: By accessing the Event, you release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Event or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including claims, costs, injuries, losses and damages related to rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. 
  5. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE SPONSOR OR THE RELEASED PARTIES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING, NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED TO YOUR PARTICIPATION IN THE EVENT OR USE, EVEN IF A RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES (JOINTLY) ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE EVENT EXCEED THE PRICE OF ANY ELIGIBLE PRODUCTS PURCHASED BY YOU DURING THE EVENT. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT EXCLUDE OR LIMIT LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY PRODUCTS RENTED OR PURCHASED FROM THE SPONSOR, OR FOR THE RELEASED PARTIES’ GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR FOR FRAUD.

    Persons accessing the Event further agree not to knowingly damage or cause interruption of the Event and/or prevent others from participating in the Event. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE, WEBSITE OR PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THE EVENT VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PERSON, WHETHER OR NOT THE INDIVIDUAL IS A PARTICIPANT IN THE EVENT, MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
  6. Privacy: Personal information provided in conjunction with purchasing during the Event is subject to Sponsor’s Privacy Policy, available at https://funko.com/mx/privacy-policy/privacy-policy.html.

TÉRMINOS Y CONDICIONES DE ACCESO AL EVENTO Y COMPRA ADICIONAL

 

Importante: Para participar en este Evento, usted debe aceptar y cumplir con estos Términos y Condiciones y todas las decisiones de Funko, LLC ("Patrocinador"), las cuales son definitivas y vinculantes en todos los aspectos.

  1. Acceso al Evento: El acceso al evento será por orden de llegada según lo administre una sala de espera automatizada. Dependiendo del volumen de tráfico del Evento, los Participantes del Evento que visiten www.funko.com/mx o www.loungefly.com/mx después de la Hora de Inicio aplicable pueden ser colocados en una cola de espera al momento de finalizar la compra por orden de llegada. El Evento comenzará (la "Hora de Inicio"): (a) para consumidores en Estados Unidos, Canadá y México a las 9:00 a.m., Hora del Este, el 9 de octubre de 2025 y (b) para consumidores en el Reino Unido, UE y EAU a las 4:00 p.m., Hora Estándar Británica, el 9 de octubre de 2025.
  2. Términos de Compra del Evento: Los participantes en el Evento pueden optar por no comprar ningún producto durante el Evento sin responsabilidad u obligación de ningún tipo. Cualquier compra de productos NYCC 2025 del Patrocinador (cada uno un "Exclusivo del Evento") durante el Evento está sujeta a los siguientes términos y condiciones además de los términos y condiciones establecidos en https://funko.com/mx/terms-and-conditions/terms-conditions.html::
    1. Disponibilidad de Productos.
      1. No se permiten múltiples finalizaciones de compra por un solo participante del Evento. Si un participante intenta o completa más de una transacción de finalización de compra, cualquiera y todas las transacciones están sujetas a cancelaciones según se establece a continuación.
      2. Límite de una (1) unidad por Paquete NYCC 2025 (SKU: 95469) por hogar. Los pedidos de múltiples Paquetes NYCC 2025 (SKU: 95469) están sujetos a cancelación según se establece a continuación.
      3. Límite de dos (2) unidades de todos los Exclusivos del Evento de Edición Limitada (SKUs: 88112, 88113, 88114, 88123, 88124 y 88126) por hogar. Los pedidos que excedan este límite están sujetos a cancelación según se establece a continuación.
      4. Límite de seis (6) unidades de todos los demás Exclusivos del Evento por hogar. Los pedidos que excedan este límite están sujetos a cancelación según se establece a continuación.
      5. No todos los Exclusivos del Evento están disponibles en todas las jurisdicciones.
      6. El acceso al Evento no garantiza la disponibilidad de ningún Exclusivo del Evento. Las cantidades de Exclusivos del Evento son muy limitadas, y se espera que todos los Exclusivos del Evento se agoten.
    2. Detalles de Compra, Verificación y Cancelación. Todas las compras de Exclusivos del Evento están sujetas a verificación antes del procesamiento y envío. Las compras pueden cancelarse en cualquier momento antes del envío en las siguientes circunstancias:
      1. El Patrocinador determina que la compra fue el resultado de acceso no autorizado al Evento.
      2. El mismo comprador intenta completar más de una transacción.
      3. El Patrocinador determina que se compraron cantidades excesivas del mismo Exclusivo del Evento por compradores en el mismo hogar en una o más transacciones.
      4. El Patrocinador determina que el comprador interfirió con o socavó, o intentó interferir con o socavar, la operación legítima de la Promoción o el Evento.
      5. El Patrocinador determina que una compra se realizó por medios automatizados (incluidas las compras realizadas mediante cualquier script, macro, bot o servicio promocional).
      6. La transacción de compra no se completó antes del final programado del Evento.
    3. Sin Devoluciones. Los Exclusivos del Evento se consideran "Exclusivos" para los fines de la política de devoluciones de la Compañía, disponible en https://funko.com/mx/funko-returns-policy/funko-returns-policy.html.

    3. Si una transacción de compra no se completa antes del final del Evento debido a que el pago intentado para el/los artículo(s) seleccionado(s) fue rechazado o por cualquier otra razón (incluyendo, a modo de ejemplo únicamente, ser tardío, perdido, corrupto, revuelto, distorsionado, retrasado, destruido, mal dirigido, inaccesible o de otra manera irregular/defectuoso), la oportunidad de acceder al Evento será rescindida por el Patrocinador sin responsabilidad de ningún tipo.

  3. Exención de Responsabilidad: El Patrocinador y sus empresas matrices, subsidiarias, afiliadas, directores, funcionarios, asesores profesionales, consultores, contratistas, asesoría legal, firmas de relaciones públicas, empleados y agencias de publicidad, cumplimiento y marketing (colectivamente, las "Partes Liberadas") no serán responsables de: (a) ninguna transmisión tardía, perdida, mal dirigida, distorsionada o dañada; (b) mal funcionamiento o fallas relacionadas con teléfono, electrónica, hardware, software, red, Internet u otras comunicaciones más allá del control razonable del Patrocinador o las Partes Liberadas; (c) cualquier interrupción, lesión, pérdida o daño del Evento causado por eventos más allá del control razonable del Patrocinador o las Partes Liberadas por intervención humana no autorizada; o (d) cualquier error de impresión o tipográfico en cualquier material asociado con el Evento.
  4. Limitaciones de Responsabilidad; Liberaciones: Al acceder al Evento, usted libera al Patrocinador y a todas las Partes Liberadas de cualquier responsabilidad, y renuncia a todas y cada una de las causas de acción, relacionadas con cualquier reclamo, costo, lesión, pérdida o daño de cualquier tipo que surja de o en conexión con el Evento o la entrega, entrega incorrecta, aceptación, posesión, uso o incapacidad de usar cualquier premio (incluidos reclamos, costos, lesiones, pérdidas y daños relacionados con derechos de publicidad o privacidad, difamación o representación bajo una luz falsa, ya sea intencional o no intencional), ya sea bajo una teoría de contrato, agravio (incluida negligencia), garantía u otra teoría.
  5. EN LA MAYOR MEDIDA PERMITIDA POR LA LEY APLICABLE, EN NINGÚN CASO EL PATROCINADOR O LAS PARTES LIBERADAS SERÁN RESPONSABLES DE NINGÚN DAÑO ESPECIAL, INDIRECTO, INCIDENTAL O CONSECUENTE, INCLUIDA LA PÉRDIDA DE USO, PÉRDIDA DE GANANCIAS O PÉRDIDA DE DATOS, YA SEA EN UNA ACCIÓN CONTRACTUAL, AGRAVIO (INCLUIDA NEGLIGENCIA) O DE OTRA MANERA, QUE SURJA DE O ESTÉ RELACIONADA DE ALGUNA MANERA CON SU PARTICIPACIÓN EN EL EVENTO O USO, INCLUSO SI UNA PARTE LIBERADA HA SIDO ADVERTIDA DE LA POSIBILIDAD DE TALES DAÑOS.

    EN LA MAYOR MEDIDA PERMITIDA POR LA LEY APLICABLE, EN NINGÚN CASO LA RESPONSABILIDAD AGREGADA DE LAS PARTES LIBERADAS (CONJUNTAMENTE) QUE SURJA DE O SE RELACIONE CON SU PARTICIPACIÓN EN EL EVENTO EXCEDERÁ EL PRECIO DE CUALQUIER PRODUCTO ELEGIBLE COMPRADO POR USTED DURANTE EL EVENTO. LAS LIMITACIONES ESTABLECIDAS EN ESTA SECCIÓN NO EXCLUIRÁN NI LIMITARÁN LA RESPONSABILIDAD POR LESIONES PERSONALES O DAÑOS A LA PROPIEDAD CAUSADOS POR PRODUCTOS ALQUILADOS O COMPRADOS DEL PATROCINADOR, O POR NEGLIGENCIA GRAVE, CONDUCTA INTENCIONAL INDEBIDA O FRAUDE DE LAS PARTES LIBERADAS.

    Las personas que accedan al Evento además acuerdan no dañar intencionalmente ni causar interrupción del Evento y/o impedir que otros participen en el Evento. PRECAUCIÓN: CUALQUIER INTENTO DE DAÑAR CUALQUIER SERVICIO EN LÍNEA, SITIO WEB O PLATAFORMA O SOCAVAR LA OPERACIÓN LEGÍTIMA DEL EVENTO VIOLA LEYES PENALES O CIVILES. SI SE REALIZA TAL INTENTO, EL PATROCINADOR PUEDE DESCALIFICAR A CUALQUIER PERSONA, SEA O NO EL INDIVIDUO UN PARTICIPANTE EN EL EVENTO, QUE REALICE TAL INTENTO Y BUSCAR DAÑOS EN LA MAYOR MEDIDA DE LA LEY.
